Terms of Service

These Terms of Service (“Terms”) apply to your use of The Untitled Space website and to purchases made from The Untitled Space (“we,” “us,” or “our”).

By using this website or placing an order, you agree to these Terms and our Refund Policy, Shipping Policy, and Privacy Policy.

1. Products and Artwork

The Untitled Space offers original artwork, sculpture, photography, works on paper, mixed-media works, prints, limited editions, publications, books, magazines, wearable art, and other art-related products.

Original artwork and limited editions are unique or available in limited quantities. Adding an item to your cart does not reserve it. All orders are subject to availability and acceptance.

We make reasonable efforts to provide accurate descriptions, images, dimensions, materials, edition information, condition details, framing information, prices, and availability. Dimensions are approximate unless otherwise stated.

Because original artworks may also be offered through exhibitions, art fairs, partner platforms, or private sales, an artwork may occasionally become unavailable before the website is updated. If an item is unavailable after an order is placed, we will cancel the affected item and refund the amount paid for it.

2. Artwork Images, Condition, and Materials

We make every reasonable effort to represent artwork accurately through professional photography, videos, descriptions, and condition information.

However:

Colors may vary depending on screen calibration, device settings, lighting, and viewing conditions.
Artwork may appear different under different lighting or in different environments.
Images should not be interpreted as exact color references.
Some framed images may be digital renderings or presentation mockups intended to illustrate scale or framing style.
Original artwork may include variations in texture, surface, finish, edges, brushwork, handmade materials, or other characteristics arising from the artist’s materials and creative process.

Works on paper may naturally exhibit slight rippling, undulation, deckled or irregular edges, variations in paper texture, and other characteristics inherent to the medium. These natural characteristics are not considered defects.

Collectors are encouraged to request additional photographs, videos, measurements, framing details, installation information, or a condition report before purchasing. Available artwork may also be viewed at the gallery by appointment.

3. Framing and Presentation

Where applicable, framing and presentation are selected or approved by the artist and/or gallery unless otherwise stated.

Frame profiles, wood grain, finishes, glazing, hardware, mounting, and other framing materials may vary slightly from photographs or digital renderings. These variations and the artist’s intended presentation are not considered defects or grounds for return.

Custom-framed, commissioned, specially ordered, altered, or otherwise customized artwork is non-refundable and non-returnable once production or customization has begun.

4. Orders, Payment, and Pricing

Prices are shown in the currency indicated on the website. Shipping charges, applicable taxes, customs charges collected at checkout, and other disclosed fees are added where applicable.

Customers are responsible for providing accurate billing, payment, email, telephone, and delivery information and for reviewing their order before completing checkout.

An automated order confirmation acknowledges that we received your order but does not guarantee final acceptance or availability. We reserve the right to decline or cancel an order because of unavailability, pricing or description errors, suspected fraud, payment issues, shipping restrictions, or other reasonable circumstances.

If we cancel an order after collecting payment, we will refund the amount charged for the canceled item.

Prices and availability may change without notice before an order is completed.

5. Final Sale, Returns, and Refunds

All sales of original artwork are final.

The following items are non-returnable and non-refundable except in cases of verified shipping damage, receipt of an incorrect item, or where a remedy is required by applicable law:

Original artwork and sculpture
Photography and mixed-media artwork
Works on paper
Prints and limited editions
Custom-framed artwork
Commissioned, specially ordered, customized, or altered artwork
Books and magazines
Limited-edition wearable items
Auction purchases and “Make an Offer” purchases
Sale or discounted items
Gift cards
Digital and downloadable products

We do not accept returns or provide refunds because a purchaser changes their mind, no longer wants the work, believes the color appears different on their screen, misjudges the scale, or objects to framing, materials, textures, or characteristics that were described, shown, inherent to the artwork, or available for review before purchase.

Do not return any item without written authorization from The Untitled Space. Unauthorized returns may be refused and returned to the sender.

Any approved return or exchange is governed by our Refund Policy. Nothing in these Terms limits rights or remedies that cannot legally be excluded.

6. Shipping, Delivery, and Pickup

Processing, shipping, and delivery dates are estimates and are not guaranteed. Oversized, fragile, unusually shaped, custom-framed, or international shipments may require additional preparation, crating, insurance, or a separate shipping quote.

We are not responsible for delays caused by shipping carriers, customs authorities, weather, incorrect addresses, building-access restrictions, recipient unavailability, or circumstances outside our reasonable control.

Customers are responsible for providing a complete and accurate delivery address. Additional shipping, storage, redelivery, or return costs resulting from an incorrect address, refused delivery, unclaimed shipment, failed delivery, or customs rejection may be charged to the customer.

International customers are responsible for customs duties, import taxes, brokerage charges, and other fees imposed by the destination country or delivery provider unless expressly stated otherwise at checkout.

Gallery pickup must be arranged in advance. Identification and proof of purchase may be required.

Shipping Damage

If an artwork or other item arrives damaged:

Notify us at art@untitled-space.com within 48 hours of delivery.
Retain all original packaging and shipping materials.
Provide clear photographs of:
- The exterior packaging
- The interior packaging
- The shipping label
- The damaged item
Do not discard, alter, install, repair, or return the item unless instructed by us.

Failure to retain the original packaging or provide the requested documentation may prevent us from submitting or completing a carrier insurance claim.

Approved damage claims may be resolved through repair, replacement, store credit, or refund, depending on the nature of the damage, availability of the work, insurance determination, and applicable law.

7. Receipts, Certificates, and Authenticity

Online purchases receive a digital order confirmation and receipt.

Original and limited-edition artworks may include a gallery or artist Certificate of Authenticity or other documentation where applicable. Paper copies of available documentation may be requested by contacting art@untitled-space.com. Please allow approximately 7–14 days for requested paper documentation to be prepared and mailed.

Certificates and documentation apply only to the artwork and edition information identified in them. Alteration, separation, unauthorized reproduction, or misuse of such documentation may invalidate its purpose.

8. Copyright and Intellectual Property

Purchasing an artwork, print, photograph, sculpture, publication, or other physical item transfers ownership of that physical object only after full payment has been received. It does not transfer copyright, reproduction rights, image rights, licensing rights, moral rights, trademark rights, or any other intellectual-property rights.

Copyright and other intellectual-property rights remain with the artist, photographer, author, gallery, or applicable rights holder unless expressly transferred in a separate written agreement.

Without prior written permission from the applicable rights holder, purchasers and website users may not:

Copy, scan, photograph for commercial use, reproduce, publish, distribute, or create editions of an artwork or publication.
Use artwork or website content in advertising, merchandise, publications, films, exhibitions, websites, social media campaigns, promotional materials, or other commercial projects.
Create derivative works, digital editions, NFTs, commercial reproductions, or merchandise based on an artwork.
Upload or use artwork or website content in artificial-intelligence systems, training datasets, image-generation platforms, or other machine-learning applications.
Remove or alter copyright notices, signatures, watermarks, credits, edition numbers, labels, or identifying information.

Personal display of a lawfully purchased physical artwork is permitted. Any reproduction, licensing, press, publication, or commercial usage request must be approved in writing in advance.

9. Website Use and Third-Party Services

You may not use this website for unlawful, fraudulent, abusive, or unauthorized purposes or attempt to interfere with its operation, security, payment systems, or content.

Our website uses third-party services, including Shopify, payment processors, shipping carriers, analytics providers, and external websites. Those services may be governed by their own terms and privacy policies.

We are not responsible for the content, availability, security, products, or practices of independent third-party websites or services.

10. Limitation of Liability

To the fullest extent permitted by law, The Untitled Space and its owners, employees, artists, agents, contractors, licensors, and service providers will not be liable for indirect, incidental, special, punitive, or consequential damages arising from use of the website or the purchase, delivery, installation, display, storage, handling, or use of a product.

To the fullest extent permitted by law, our total liability relating to a purchase will not exceed the amount paid for the item giving rise to the claim.

These limitations do not apply where liability cannot legally be limited or excluded.

11. Privacy

Our collection and use of personal information are governed by our Privacy Policy.

12. Governing Law

These Terms are governed by the laws of the State of New York, without regard to conflict-of-law principles.

Any dispute arising from these Terms or a purchase will be handled by a court with jurisdiction in New York County, New York, except where applicable consumer law requires otherwise.

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in effect.
